AURÉA — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AURÉA website (the "Site"), the AURÉA Glow Mask product, and related services (collectively, the "Services") operated from Iselin, New Jersey, United States. By accessing or using the Site or placing an order, you agree to be bound by these Terms.

If you do not agree, please do not use the Site or purchase from us.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account. By using the Services, you represent that you meet this requirement.

2. The Product

The AURÉA Glow Mask is an at-home LED light therapy device. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. Results vary by individual. We make no medical claims. Always consult a licensed dermatologist for medical skin concerns.

The product is certified to FCC, CE, RoHS, and UL safety standards. Use as directed in the included quick-start guide and the How It Works and Care pages.

3. Account

You may place an order as a guest or by creating an account. If you create an account:

  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use

4. Orders, Pricing, and Payment

  • All prices are listed in USD unless otherwise noted
  • We reserve the right to change prices at any time before you place an order
  • Once an order is placed and confirmed, the price at the time of order is binding
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability — in which case we will issue a full refund
  • Payment is processed at the time of order through Shopify Payments, Shop Pay, PayPal, or other supported methods

5. Shipping

Shipping terms, rates, and delivery times are described in our Shipping Policy. Risk of loss and title pass to you upon delivery by the carrier to the address you provided.

6. Returns and Refunds

Returns and refunds are governed by our Refund Policy. The 30-day money-back guarantee and all conditions described there form part of these Terms.

7. Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site or our systems
  • Interfere with the Site's normal operation
  • Use any automated means (bots, scrapers, etc.) to access or copy content from the Site without our express written permission
  • Resell AURÉA products through unauthorized channels (third-party marketplaces like Amazon, eBay, AliExpress)

8. Intellectual Property

All content on the Site — including the AURÉA name, logo, product designs, photography, copy, illustrations, and videos — is owned by AURÉA or its licensors and is protected by US and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any AURÉA content without our prior written consent.

9. User-Submitted Content

If you submit reviews, photos, videos, or any other content to the Site or to us directly (including via email or social media tags), you grant AURÉA a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content for marketing, customer support, and operational purposes. You represent that you own the content you submit and that it does not infringe any third-party rights.

10. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses. We do not warrant any specific skincare results from use of the AURÉA Glow Mask — results vary by individual, consistency of use, skin type, and other factors outside our control.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AURÉA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY EXCEPT WHERE PROHIBITED BY LAW) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.

Our total liability for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the amount you paid AURÉA in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above limitation may not apply to you.

12. Indemnification

You agree to indemnify and hold AURÉA, its officers, employees, and affiliates harmless from any claim, demand, loss, or liability arising out of your breach of these Terms, your misuse of the Services or products, or your violation of any law or third-party right.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved through:

  1. Good-faith negotiation first — contact us at marqueestudiosnj@gmail.com and we will attempt to resolve the dispute informally within 30 days
  2. Binding arbitration if good-faith negotiation fails, conducted in Middlesex County, New Jersey, under the rules of the American Arbitration Association
  3. Small claims court in Middlesex County, New Jersey is also an option for qualifying disputes

You agree to bring claims only in your individual capacity and not as a class action or representative proceeding.

14. Modifications to These Terms

We may update these Terms from time to time. The current version is always posted on this page, with the "Effective date" reflecting the latest revision. Continued use of the Services after the Effective date constitutes acceptance of the revised Terms. Material changes will be flagged via banner notice or email where possible.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with the Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and AURÉA regarding your use of the Services.
